Patriot Warranty Victim Speaks Out as AG Seeks Injunction

The Case of Patriot Warranty and the Impact on Consumers

In Sioux Falls, South Dakota, there is a strong sense of pride in the hardworking and honest nature of its residents. However, this image was challenged when a questionable business entity chose to establish its headquarters in the state. This decision raised concerns about how such an operation could potentially tarnish the reputation of South Dakota’s business community.

Ayman Badwan, a consumer who purchased a car repair warranty from what appeared to be a local company called Patriot Warranty, found himself in a difficult situation. He paid $720 for the service, but when his car required repairs, the company refused to cover the cost. Instead, they promised a refund of his policy.

“I was told that on the 15th of the month, I would receive the check. I never got it,” Badwan said in 2022.

This experience led him to file a complaint with the South Dakota Attorney General’s consumer protection division. He was one of 419 individuals who reported similar issues with Patriot Warranty.

Legal Action Taken Against the Company

The South Dakota Attorney General, Marty Jackley, took action by issuing an injunction against Patriot Warranty and two of its owners. This legal move ensured that the company could no longer operate in the state. As part of the case, the company was fined a total of over $35,000.

Jackley emphasized the importance of protecting consumers not only within South Dakota but across the nation. “One of the biggest concerns I’ve had as Attorney General is that we don’t want sham businesses coming to South Dakota and hurting others,” he stated. “I think this reflects poorly on us as a state. And I think this shows that we’re willing to protect consumers nationwide.”

The court’s agreement with the injunction has prevented Patriot Warranty from continuing to defraud consumers.

Broader Implications Across States

South Dakota is not the only state facing issues with the owners of Patriot Warranty. The state of Colorado also filed an injunction, while Florida issued a cease and desist order. These actions targeted the same main owner, Jack C. Yedid. Another co-owner, Charles Seruya, has been linked to investigations in Pennsylvania, New Jersey, and California.

For Badwan, the legal actions taken against the company are a positive development. However, he still awaits the refund he was promised. Because he resides outside of South Dakota, he may need to reach out to his own state’s Attorney General’s office to seek resolution for his claim.

Ongoing Challenges for Consumers

The case of Patriot Warranty highlights the challenges consumers face when dealing with unscrupulous businesses. While legal actions can provide some relief, the process of recovering lost funds can be lengthy and complicated. For individuals like Badwan, the lack of a timely refund remains a significant concern.

This incident also underscores the importance of vigilance when choosing service providers. Consumers should be cautious and verify the legitimacy of companies before entering into any agreements. Additionally, reporting suspicious activities to relevant authorities can help prevent further harm to others.

As more states take action against entities like Patriot Warranty, it becomes clear that the fight against fraudulent practices requires collaboration and awareness. By working together, consumers and regulatory bodies can create a safer environment for all.
