Mother Found Guilty in Child Neglect Case Ruled Incompetent for Sentencing After Fatal Shooting

The Case of Kimberly Grayson

A Delaware County judge has ruled that Kimberly Grayson is incompetent to proceed with sentencing. This decision came after a jury convicted the 32-year-old Muncie mother in March of neglect of a dependent resulting in death and three counts of neglect of a dependent. The court record indicates that Grayson lacks the ability to understand the court proceedings and cannot assist her defense. As a result, her sentencing has been delayed indefinitely while she receives mental health services.

The tragic incident involved Grayson’s 6-year-old son, who found a gun in an unlocked safe and shot and killed his 5-year-old sister on July 26, 2022. This event led to the charges against both parents, with the father, Jacob Grayson, also facing the same charges. He is scheduled to go on trial on October 5.

Details of the Incident

Investigators concluded that the girl’s 6-year-old brother retrieved a gun from a safe and shot his sister. According to court documents, when police interviewed Kimberly, they noted that she acknowledged the key to unlock the safe may have been left in the lock. During an interview with police, Kimberly said she believed she was only asleep for 5 minutes.

Court documents state that the boy told police he was playing with the gun when he accidentally shot his sister. The conditions in the home were described as “deplorable,” and two of the charges in the case were related to “inhabitable housing conditions” for the children.

Parental Statements and Actions

Police also spoke with Jacob while responding to the incident. He mentioned that his son had gotten into the safe before. Jacob stated that he moved the safe from its previous location after his son got in it, but he acknowledged that the new location was not out of reach for the boy.

Jacob and Kimberly told police they had taken their 6-year-old son to a shooting range to show him how to shoot a gun. This information raises questions about the parents’ awareness of the dangers associated with firearms and their responsibility in ensuring the safety of their children.

Ongoing Legal Proceedings

With the sentencing of Kimberly Grayson delayed, the focus now shifts to the upcoming trial of Jacob Grayson. His trial date is set for October 5, and the court will examine the evidence related to the incident and the conditions in the home. The case highlights the importance of responsible gun ownership and the need for parents to ensure the safety of their children.

As the legal process continues, the community is left grappling with the tragedy and the broader implications of this case.
