New Customs Policy in Thailand Poses Risks for Travelers with Cannabis

A recent change in customs policy in Thailand has introduced significant risks for travelers who carry cannabis products, even unintentionally. According to the U.S. Embassy and Consulate in Thailand, individuals caught with cannabis in their luggage could face up to 10 years in prison, a fine of nearly $15,000, or both. This new rule, which took effect on June 17, replaces the previous policy of confiscation without charge. While cannabis was decriminalized in Thailand in 2022, it remains illegal to transport it across borders without proper permissions.

Travelers should be aware that they are subject to local laws when traveling abroad. The U.S. government cannot guarantee your release if you are detained or arrested in another country. This warning highlights the importance of understanding and respecting the legal framework of the destination country before departure.

International Consequences of Traveling with Cannabis

Thailand is not the only country where travelers could face serious trouble for bringing cannabis products. In 2022, WNBA star Brittney Griner was arrested in Russia after vape cartridges containing cannabis oil were found in her luggage. Despite claiming the items were prescribed medical cannabis for pain management, she was sentenced to prison and served 10 months before being released under a prisoner exchange deal.

Griner shared her experience with USA TODAY, emphasizing the importance of awareness and preparation for travelers. “I never want anybody to go through what I went through,” she said. “I’m aware that I’m very blessed and very lucky to have an agency team, my wife and everybody behind me. I want people to be able to be aware, informed and to know where they’re going, where they’re traveling.”

Understanding the Legal Landscape

For many travelers, the distinction between using cannabis within a country and importing or exporting it can be confusing. Even items that seem harmless at home, like cannabis-infused gummies, can lead to severe consequences abroad. According to Dan Richards, founder and CEO of Global Rescue, a travel risk and crisis response provider, traveling with cannabis products is illegal nearly everywhere.

Richards explained that while some countries allow the purchase and consumption of cannabis, transporting it across borders is considered trafficking. For example, in the Netherlands, where cannabis can be bought for personal use, carrying it across borders can result in serious legal issues. Law enforcement may not make exceptions, even for small amounts.

Countries with Strict Penalties

In certain countries, such as Turkey or Egypt, being caught with cannabis can result in hefty fines and imprisonment. These penalties vary depending on the country’s legal framework and enforcement practices. Richards noted that the severity of the consequences can range from minor issues to life-altering situations.

Precautions for Travelers

To avoid legal trouble, travelers should take several precautions. First, thoroughly inspect your bags before departing on your trip to ensure that no cannabis products are accidentally included. If you are at a U.S. airport and discover cannabis substances, dispose of them immediately. As Richards emphasized, “The time to remember is before you get through security and obviously on the airplane to the place you’re going.”

Additionally, research the legal status of cannabis and other prohibited items at your destination. The U.S. State Department’s international travel page provides valuable information on what is illegal in different countries. For instance, Turks and Caicos has strict firearms and ammunition laws that are strongly enforced at airports. A single bullet discovered in someone’s suitcase could result in arrest, fines, and long-term jail sentences.

The State Department also offers travel advisories that include essential information such as entry and exit requirements, health considerations, and local laws. These resources help travelers make informed decisions and avoid potential legal issues.

“People do this kind of stuff all the time. … There’s intentionality with some part of the population, but there’s a whole bunch of people that do it accidentally,” Richards said. “Different countries have different rules about all kinds of things.”
